Private Charter Reservation, Cancellation & Refund Policy

These terms govern your private charter reservation, payment, check-in, cancellation, passenger weights, baggage, no-shows, safety requirements and refunds.

1. Charter agreement and scope

This Reservation Policy forms part of the private charter agreement between the customer who makes or pays for the reservation (“Customer” or “Charterer”) and Taxi Aéreo. The Customer is responsible for ensuring that all passengers included in the reservation comply with the operational requirements that apply to the flight.

A private charter reserves aircraft capacity, crew scheduling and associated operational resources for a specific route, date and departure time. Unless expressly stated otherwise in writing, the Customer is purchasing the charter of the aircraft and not individual airline seats. A reduction in passenger count after booking does not reduce the charter price.

A quotation or flight request is not a confirmed reservation. A reservation is confirmed only after Taxi Aéreo accepts the flight, receives or approves the required payment, and issues a reservation confirmation.

2. Payment, confirmation and total price
  • Full payment is required unless Taxi Aéreo expressly approves different written payment terms.
  • The amount shown in the reservation confirmation is the agreed charter amount for the confirmed itinerary, subject to later Customer-requested changes accepted in writing.
  • Carrier-imposed fees, government taxes/fees, after-hours fees, or known third-party charges for which the Customer is responsible will be disclosed as required by applicable law and, when applicable, in the quote or reservation confirmation.
  • Refunds are processed to the original payment method whenever reasonably possible.
3. Customer cancellations, refunds and travel credit
  • If scheduled departure is more than 24 hours away, the Customer may request a full refund by cancelling in writing within the first 24 hours after Taxi Aéreo confirms the reservation.
  • A reservation confirmed within 24 hours of scheduled departure is non-refundable once confirmed, except where applicable law requires a refund or Taxi Aéreo approves one in writing.
  • After the applicable 24-hour refund window expires, the charter payment is non-refundable for a voluntary Customer cancellation.
  • If requested at least 48 hours before departure, Taxi Aéreo may, subject to availability and operational feasibility, permit an itinerary change or issue travel credit valid for one year from the original agreement date. Fare differences, repositioning costs and additional charges must be paid before confirmation.
  • Within 48 hours of departure, changes, credits and voluntary refunds are not guaranteed and may be denied.
  • Same-day Customer cancellations and no-shows are non-refundable except where applicable law requires otherwise.

Cancellation requests must be sent by the Customer or cardholder to reservations@taxiaereopr.travel. A cancellation is effective when received and acknowledged by Taxi Aéreo.

4. Required check-in, flight closing and no-show

The scheduled departure time is not the time the Customer should arrive. Taxi Aéreo reserves an aircraft, crew and operational resources for the agreed departure time.

  • Puerto Rico domestic: all passengers must report for check-in at least 50 minutes before scheduled departure.
  • International / U.S. Virgin Islands: all passengers must report at least 90 minutes before scheduled departure.
  • Hard flight closing: 30 minutes before scheduled departure, unless the confirmation states an earlier deadline required by customs, immigration, an airport or another governmental authority.

“Checked in” means required passengers are physically present and available to complete applicable identity/document review, passenger weighing, baggage acceptance, security, customs/immigration and crew procedures.

Arrival after the required check-in time does not obligate Taxi Aéreo to delay the aircraft. Taxi Aéreo may attempt to accommodate a late Customer when operationally possible, but is not required to do so.

If a required passenger has not completed check-in by the applicable flight-closing deadline, Taxi Aéreo may declare the reservation a NO-SHOW. A Customer-caused no-show is a Customer cancellation and results in forfeiture of 100% of the charter payment, except where applicable law requires otherwise.

The fact that the aircraft remains physically on the ground when a late passenger arrives does not create a right to transportation, flight delay, refund or credit after the applicable check-in/closing requirements have not been satisfied.

5. Customer-caused delay and waiting time

Taxi Aéreo is not required to hold an aircraft because a passenger is late, unprepared, missing documentation or otherwise unable to depart.

If Taxi Aéreo agrees to wait, waiting remains subject to aircraft availability, crew duty limitations, subsequent bookings, airport restrictions, customs/immigration requirements and safety considerations. Approved waiting time is billed at $100 per hour in one-hour increments unless the confirmation states a different amount. Payment of a waiting charge does not guarantee continued aircraft availability.

6. Accuracy of reservation information

The Customer must provide complete and accurate information requested for operational planning, including passenger names/count, individual passenger weights, baggage quantity/type/size/weight, pets when applicable, contact information and travel/document information reasonably required for the itinerary.

Taxi Aéreo relies on this information when assigning aircraft, planning payload/fuel, calculating weight and balance, scheduling crew and determining whether the charter can be safely and legally performed. Materially inaccurate, incomplete or misleading information may require changes to aircraft, seating, baggage, passenger count, departure time, additional charges, rescheduling, or may make the flight impossible to operate.

7. Passenger weights and weight-and-balance limitations

Passenger weights supplied during booking must be accurate. Taxi Aéreo may verify each passenger’s actual weight on a scale during check-in. When required by the crew or operator, weighing is an operational safety procedure required before transportation.

A difference between declared and actual weight is “material” when it affects aircraft loading, seating, baggage placement, fuel, passenger capacity, weight and balance, aircraft operating limitations or the ability to safely and legally perform the flight. A small reasonable variation that does not affect operation is not, by itself, a basis for forfeiture.

If actual weights materially differ, Taxi Aéreo may reassign seats, redistribute/reduce baggage, reduce passenger count, require an additional flight/aircraft, substitute a suitable aircraft if available, delay/reschedule, or decline to operate when necessary to remain within operating limitations.

If Taxi Aéreo was ready and able to perform the charter based on the information supplied, but the flight cannot be safely or legally performed because materially inaccurate passenger weights were supplied by the Customer or passengers, the resulting inability to travel is Customer-caused nonperformance and the charter payment is non-refundable, except where applicable law requires otherwise.

This policy is applied on the basis of legitimate aircraft safety and operational limitations and not on disability or another legally protected status.

8. Baggage declaration, excess baggage and aircraft limits

All baggage is subject to the assigned aircraft’s weight, balance, volume, baggage-door dimensions, compartment limits and safe-loading requirements. Published baggage limits are maximums and are not a guarantee that every combination of passengers and baggage can be carried.

The Customer must accurately disclose the quantity, type, approximate size and weight of baggage when requested. Taxi Aéreo may weigh, measure or inspect baggage at check-in.

Undeclared, oversized, overweight or excess baggage is not guaranteed transportation. Taxi Aéreo may require baggage to be redistributed, removed, left behind, transported separately, carried on an additional flight or moved to another suitable aircraft when available, with applicable additional cost.

If Taxi Aéreo remains willing and able to transport the passengers but a Customer elects not to travel because undeclared or excess baggage cannot be carried, the Customer’s decision is a voluntary cancellation/no-show and is non-refundable.

If the charter cannot be safely or legally operated because the Customer materially understated or failed to disclose baggage, the resulting inability to operate is Customer-caused nonperformance and the charter payment is non-refundable, except where applicable law requires otherwise.

If the Customer accurately disclosed specific baggage and Taxi Aéreo expressly accepted it as part of the confirmed charter, this section does not eliminate a refund or other remedy required by applicable law if Taxi Aéreo later cannot provide the agreed transportation.

9. Identification, customs, immigration and travel documents

Passengers are responsible for possessing all identification, passports, visas, immigration authorization, customs documents, permits and other documents legally required for the itinerary, and for providing requested information early enough for required governmental filings and processing.

If transportation cannot occur because a passenger lacks required documents, supplies incorrect information, is denied entry, fails required government processing, or fails to timely comply with a governmental requirement, the resulting inability to travel is generally Customer-caused and non-refundable except where applicable law requires otherwise.

10. Aircraft/operator changes and required charter disclosures

Taxi Aéreo may substitute an appropriate aircraft when operationally necessary, provided transportation can be performed safely and legally and required disclosures are made.

If another direct air carrier or direct foreign air carrier will be in operational control, Taxi Aéreo will make disclosures required by applicable law, including identifying the carrier in operational control and the capacity in which Taxi Aéreo is acting when required.

If information required under applicable charter rules is not timely provided, or changes and is not timely disclosed, the Customer will receive any cancellation and refund opportunity required by applicable law. Nothing in this Policy limits rights under 14 CFR § 298.80 or other mandatory law.

11. Weather, maintenance, ATC, airport conditions and operator cancellation

The Pilot in Command and Taxi Aéreo retain final authority to determine whether a flight can be safely and legally operated. A flight may be delayed, rerouted, rescheduled or cancelled because of weather, maintenance, air traffic control, airport conditions, governmental restrictions, security matters, crew duty limitations, safety concerns or other operational circumstances.

An operator-caused cancellation is different from a Customer no-show or Customer-caused inability to operate. If Taxi Aéreo cannot provide the contracted transportation for a reason not caused by the Customer, Taxi Aéreo will provide the refund, rescheduling, credit or alternative transportation required by applicable law and the circumstances of the charter.

Nothing in this Policy converts a legally required refund into a non-refundable credit without the Customer’s agreement.

12. Passenger conduct, crew authority and safety

Passengers must comply with lawful safety instructions. Taxi Aéreo may refuse or discontinue transportation when reasonably necessary for aviation safety or when transportation would violate applicable law, including threatening/violent conduct, interference with crewmembers, refusal to follow lawful safety instructions, or conduct creating an actual safety or operational concern.

If transportation is refused because of prohibited passenger conduct rather than Taxi Aéreo’s failure to provide the contracted service, payment may be forfeited to the extent permitted by law. These provisions will be administered consistently with applicable disability and nondiscrimination law.

13. Pets and service animals

Pet transportation is subject to aircraft capacity, weight and balance, available space, destination requirements, safety and the terms confirmed for the reservation. A large pet may reduce available passenger or baggage capacity or require additional space/aircraft arrangements.

A qualified service animal is not treated as an ordinary pet for purposes of this Policy. Service-animal transportation will be handled under applicable law and legitimate aviation safety requirements.

14. Hazardous materials

Passengers may not offer prohibited hazardous materials for transportation. Certain common passenger articles are regulated and may only be transported when permitted by applicable rules and Taxi Aéreo procedures.

Passengers must comply with crew instructions and should review FAA PackSafe. Discovery of prohibited hazardous material may result in refusal of the item, delay, removal of a passenger or cancellation when necessary for safety or legal compliance.

15. Delays and consequential travel expenses

To the extent permitted by applicable law, Taxi Aéreo is not responsible for indirect or consequential expenses caused by delays, rerouting, rescheduling, weather, airport conditions, ATC restrictions or other circumstances outside Taxi Aéreo’s reasonable control, including hotels, rental vehicles, ferries, meals, missed airline connections, cruises, tours or independently purchased travel arrangements.

Nothing in this section excludes liability or remedies that applicable law does not permit the parties to waive.

16. Credit/debit card payments and payment disputes

The Customer authorizes the agreed charter amount shown in the reservation confirmation to be charged using the payment method provided.

A card dispute or chargeback does not itself cancel or modify the underlying charter agreement or Reservation Policy accepted at purchase. Nothing in this Policy prevents a cardholder from exercising rights that cannot legally be waived under applicable law or card-network rules.

If a transaction is disputed, Taxi Aéreo may provide its processor, acquiring bank, issuing bank, card network, court, governmental authority or other authorized party with records reasonably necessary to document the transaction and performance, including reservation confirmation, amount, accepted policy version, electronic acceptance record, passenger/baggage declarations, payment reference, communications, check-in/arrival records, scale records, calendar/aircraft assignment records, cancellation requests and evidence explaining why transportation was or was not completed.

17. Operational records and evidence of performance

Taxi Aéreo may maintain business and operational records associated with a reservation, including timestamps, reservation data, communications, check-in status, passenger weights, baggage records, flight/aircraft assignment, payment status and staff notations, subject to applicable privacy and recordkeeping requirements.

When a Customer does not travel, Taxi Aéreo may document the reason, including late arrival/no-show, missing documents, inaccurate passenger weights, excess baggage, Customer cancellation, prohibited conduct, weather, maintenance or another operational cause.

18. Electronic acceptance, policy version and applicable law

The Policy version accepted at booking forms part of that reservation. Taxi Aéreo may update its public policy for future transactions, but a later website edit does not retroactively replace the version accepted for an earlier reservation unless the parties agree in writing or a change is required by law.

By checking the required acceptance box, electronically signing, signing a related document, or otherwise affirmatively accepting these terms before payment, the Customer acknowledges having had the opportunity to review this Policy, including cancellation, no-show, refund, passenger-weight and baggage terms.

This agreement is subject to applicable United States federal aviation law and applicable law of Puerto Rico. If any provision is unenforceable, the remaining provisions remain effective to the extent permitted by law. Nothing in this Policy waives a right or remedy that applicable law prohibits the parties from waiving.

Acceptance of these termsBefore payment, the Customer must affirmatively acknowledge that this is a private aircraft charter reserved for a specific departure time; that the applicable check-in and 30-minute flight-closing deadlines apply; and that a Customer-caused no-show, materially inaccurate passenger weights, undeclared or excess baggage, missing travel documents, or another Customer-caused condition that prevents safe or legal operation may result in forfeiture of the charter payment as described in this Policy.

Acceptance of these terms

By affirmatively accepting this Policy before payment, the Customer acknowledges the cancellation, refund, no-show, passenger-weight, baggage and other terms that apply to the reservation. Taxi Aéreo may retain the policy version and acceptance record associated with the transaction.
